Terms of service
Company registration details shown in brackets are being added and will be filled in before paid plans open.
The short version: you send us a spreadsheet and a question, and we send back a forecast and a plan. Forecasts are estimates, not guarantees, so you stay in charge of your decisions. You own your data. If something goes wrong, our liability is limited to what you paid us in the last 12 months.
1. Who you are agreeing with
These terms are an agreement between you and [Company legal name] ApS, a Danish company (CVR [CVR number]), [Registered address], Denmark ("4castPlannr", "we", "us"). By uploading a file, joining a plan or otherwise using 4castPlannr you accept these terms. If you use 4castPlannr for a company, you confirm that you may accept them on its behalf. 4castPlannr is a business service: you must be at least 18 and use it for your business, not for personal or household purposes.
2. What we provide
You upload business data (for example a sales export) and describe what you want to predict or decide. We prepare a forecast, test it on your own history, and, when you ask about a decision, recommend a plan such as how much to order, produce or staff. We may ask you questions before we start. We may improve, change or stop parts of the service; if we stop something you pay for, we refund the unused part.
3. The free forecast
The first 50 businesses get free forecasts, one business per request. We may decline a request that is not a good fit, for example if the file has too little history, and we will tell you why. The free offer ends when the 50 places are taken.
4. Paid plans and founder pricing
The founder plan costs $20 per month, billed monthly in US dollars. Paid signup is not open yet; until it is, nobody is charged. When it opens:
- We will only charge you after you choose a plan and agree to the price at checkout.
- Founder pricing stays at the price you signed up at for as long as your subscription stays active. If you cancel and come back later, current prices apply.
- Prices do not include taxes. Where the law requires it, applicable VAT or sales tax is added at checkout.
- You can cancel any time. Cancellation takes effect at the end of the month you have paid for, and you will not be charged again. We do not refund partial months, except where the law requires it or we say otherwise.
- Work outside the plan, such as a custom planning model, is quoted in writing first. You decide whether to go ahead.
- If we ever change prices for other plans, we give at least 30 days' notice by email.
5. Your data
You keep all rights to the files you upload and to the results we produce for you. You give us permission to use your data only to provide the service to you, including fixing errors and keeping it secure. We do not sell your data and we do not use it to train models offered to other customers.
You confirm that you are allowed to share the data with us and that sharing it does not break any law or agreement. Please do not upload sensitive personal data such as health information, government ID numbers, or bank or card numbers. Where your files contain personal data about other people, our data processing terms apply and form part of these terms. Our privacy policy explains how we handle personal data and how long we keep it.
We may use anonymous, aggregated statistics about how the service performs (for example how often forecasts beat a simple rule) to improve it and to describe it publicly. These never identify you, your products or your customers.
6. Forecasts are estimates, not guarantees
A forecast is our best estimate of the future based on your past data and the information you give us. The future can differ, sometimes a lot. Plans depend on the costs, limits and assumptions you provide or that we assume and label in the report. We show measured accuracy and assumptions so you can judge how much to rely on them.
You decide whether and how to act on a forecast or plan, and you are responsible for those decisions, such as orders placed, products made or shifts scheduled. 4castPlannr does not give financial, legal or tax advice.
7. Fair use
Do not upload malicious files, try to access other customers' data or our systems, overload or probe the service, resell it without our written permission, or use it for anything unlawful. We may suspend access if you do, and we will tell you why unless the law or security prevents it.
8. Our software
The 4castPlannr software, website and reports format remain ours. You may use and share the reports and results we deliver to you within your business and with your advisers. If you send us ideas or feedback, we may use them without owing you anything.
9. Availability
We work hard to keep 4castPlannr running and to deliver on time, but the service is provided as is and as available. We do not promise it will always be available or error free, or that every forecast will be accurate.
10. Limits on our liability
To the extent the law allows:
- Our total liability for all claims connected with 4castPlannr is limited to the amount you paid us in the 12 months before the event that caused the claim. If you have only used the free forecast, it is limited to US$100.
- We are not liable for indirect or consequential losses, such as lost profits, lost sales, spoiled stock, excess inventory or business interruption, including losses from decisions made using a forecast or plan.
- These limits do not apply to losses caused by our gross negligence or intent, or to anything that cannot be limited by law.
You are responsible for claims by third parties that arise from data you uploaded without the right to do so.
11. Ending the agreement
You can stop using 4castPlannr and cancel at any time by emailing hello@4castplannr.com or, once available, in your account. We may end the agreement with 30 days' notice, or right away if you seriously break these terms. When the agreement ends we delete your files and results as described in the privacy policy. Ask us before then if you want a copy.
12. Changes to these terms
We may update these terms. We will change the date at the top, and email paying customers at least 30 days before a change that affects them for the worse. If you do not agree, you can cancel before the change takes effect.
13. Law and disputes
These terms are governed by the laws of Denmark, without regard to conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Please contact us first so we can try to sort it out. If we cannot, disputes go to the courts of Denmark, with the Copenhagen City Court (Københavns Byret) as the first instance, unless the law where you are says otherwise.
14. The rest
If part of these terms cannot be enforced, the rest still applies. If we do not enforce a right right away, we have not given it up. You may not transfer this agreement without our consent; we may transfer it to a company that takes over 4castPlannr and will tell you if we do. Neither of us is responsible for delays caused by events outside reasonable control, such as major outages at our providers.
